These Terms of Service ("Terms") govern your access to and use of the Simple Build AI platform, including our website at simplebuildai.com, AI website builder, hosting services, domain registration, and all related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.
1 Acceptance of Terms
By creating an account, subscribing to a plan, or otherwise accessing our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Cookie Policy. These Terms constitute a legally binding agreement between you and Simple Build AI.
2 Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use our Services. By agreeing to these Terms, you represent that you have the legal authority to enter into a binding contract. If you are using our Services on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.
3 Account Registration
- You must provide accurate, complete, and up-to-date information when creating an account
- You are responsible for maintaining the confidentiality of your password and account credentials
- You are responsible for all activity that occurs under your account
- You must notify us immediately of any unauthorized use of your account
- We reserve the right to suspend or terminate accounts that violate these Terms
- One person or entity may not maintain more than one free trial account
4 Our Services
Simple Build AI provides the following services:
- AI Website Builder: An artificial intelligence-powered tool that generates website code based on your inputs and preferences
- Website Hosting: Cloudflare-powered edge hosting with global CDN, SSL, and DDoS protection at $15/month
- Domain Registration: Domain name registration through our ICANN-accredited registrar partner (20i)
- Code Editor: An in-app code editor for customizing generated websites
- Integrations: Third-party tracking and analytics integration tools
We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time with reasonable notice.
5 Subscriptions & Billing
- Plans: We offer Starter ($10/mo), Pro ($35/mo), and Elite ($68/mo) subscription plans with annual billing discounts
- Recurring Billing: Subscriptions automatically renew at the end of each billing period unless cancelled
- Payment: All payments are processed securely through Stripe. You authorize us to charge your payment method on file
- Price Changes: We may change subscription prices with 30 days' prior notice. Existing subscriptions will be honoured until the end of the current billing period
- Refunds: Subscription fees are generally non-refundable. If you cancel mid-cycle, you retain access until the end of the paid period. Refund requests may be considered on a case-by-case basis within 14 days of initial purchase by contacting support@simplebuildai.com
- Failed Payments: If a payment fails, we may suspend your account after reasonable notice and retry attempts
6 Free Trial
- New users may be eligible for a 7-day free trial on select plans
- No credit card is required to start the free trial
- If you do not cancel before the trial ends, your card will be automatically charged for the chosen plan
- Each individual or entity is entitled to one free trial only
- We reserve the right to modify or discontinue the free trial offer at any time
7 Domain Registration
- Domain names are registered through our registrar partner (20i) and are subject to their registration agreement and ICANN policies
- Domain registration fees are non-refundable once the domain has been registered
- You are responsible for providing accurate WHOIS contact information as required by ICANN
- Domain availability is not guaranteed until registration is confirmed
- Domains must be renewed before expiration to prevent loss. We will send renewal reminders, but it is your responsibility to ensure timely renewal
- We are not responsible for domain disputes or third-party claims against your registered domains
- Domain transfers away from our platform are permitted in accordance with ICANN transfer policies
8 Website Hosting
- Hosting is provided via Cloudflare's edge network at $15/month per website
- We provide a 99.9% uptime SLA for hosted websites
- Hosting includes: global CDN, free SSL, DDoS protection, daily backups, unlimited bandwidth, and edge caching
- You may not use hosting for: file storage/sharing services, cryptocurrency mining, proxy/VPN services, or any illegal activity
- We reserve the right to suspend hosting for sites that violate our Acceptable Use Policy or consume disproportionate resources
- If you cancel hosting, your website will become inaccessible. You may export your HTML code at any time
9 AI-Generated Content
- Ownership: You own the website content generated by our AI tools based on your inputs. Simple Build AI retains no ownership rights to your generated content
- No Guarantee: AI-generated content is provided "as is." While we strive for quality, we do not guarantee that generated content will be error-free, unique, legally compliant, or suitable for any particular purpose
- Your Responsibility: You are responsible for reviewing, editing, and ensuring that all content published on your website complies with applicable laws, does not infringe third-party rights, and is accurate
- AI Limitations: AI models may occasionally generate inaccurate, biased, or inappropriate content. We recommend human review before publishing
- Credits: AI generation features are subject to monthly credit limits based on your subscription plan
10 Acceptable Use Policy
You agree not to use Simple Build AI to:
- Create websites that promote illegal activities, violence, hate speech, or discrimination
- Distribute malware, viruses, or any harmful code
- Engage in phishing, spam, or fraudulent activity
- Infringe upon copyrights, trademarks, or other intellectual property rights
- Harvest, scrape, or collect personal data of others without consent
- Create deceptive websites impersonating other businesses or individuals
- Host adult content, gambling, or regulated substance sales without proper licensing
- Attempt to hack, reverse-engineer, or disrupt our platform or other users' websites
- Resell or redistribute our Services without authorization
- Use automated systems to abuse API endpoints or exceed fair usage limits
Violation of this policy may result in immediate account suspension or termination without refund.
11 Intellectual Property
- Our IP: The Simple Build AI platform, including its software, design, branding, AI models, and documentation, is owned by Simple Build AI and protected by intellectual property laws
- Your Content: You retain all rights to content you create, upload, or generate using our platform
- License to Us: By using our Services, you grant us a limited license to host, display, and transmit your content solely for the purpose of providing the Services
- Feedback: Any feedback, suggestions, or ideas you provide about our Services may be used by us without obligation to you
12 Termination
- By You: You may cancel your subscription at any time through the Stripe billing portal or by contacting support. You retain access until the end of your paid period
- By Us: We may suspend or terminate your account if you violate these Terms, engage in fraud, or abuse our Services. We will provide notice when reasonably possible
- Effect: Upon termination, your right to use the Services ceases. We may delete your account data after 30 days. Hosted websites will be taken offline
- Data Export: You may request an export of your website code before termination. We recommend downloading your data regularly
- Survival: Sections relating to intellectual property, disclaimers, liability limitations, and indemnification survive termination
13 Disclaimers
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR AVAILABILITY.
We do not warrant that:
- The Services will be uninterrupted, error-free, or secure
- AI-generated content will be accurate, complete, or fit for any particular use
- Domain registration will always be successful or uncontested
- Your website will achieve any particular traffic, revenue, or business result
14 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIMPLE BUILD AI AND ITS DIRECTORS, EMPLOYEES, PARTNERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.
OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
15 Indemnification
You agree to indemnify, defend, and hold harmless Simple Build AI and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the Services or violation of these Terms
- Content you create, publish, or host through our platform
- Your violation of any law or the rights of a third party
- Any dispute between you and a third party related to your website
16 Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the Services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA), except that either party may seek injunctive relief in a court of competent jurisdiction.
You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against Simple Build AI.
17 Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you via email or by posting a prominent notice on our website at least 30 days before the changes take effect. Your continued use of the Services after the effective date constitutes acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Services and cancel your subscription.
